I love the feel of the rifle, but with them out of business, and if they re-surface no guarantee that the KP1 will still be in the catalog, I think I'll have to pass.

I'm not sure how low the price would have to go, but my decision wouldn't be predicated on whether or not the gun was still being actively manufactured. I spent a couple hundred dollars (and more than a few hours) finishing an 03A3 over the last six months. A well-made rifle (like the KP1) is not likely to need any repairs for many years, and even then, it probably wouldn't be anything that a good gunsmith couldn't fix.
With that being said, I'd be more likely to buy the Apex, simply because the reviews on it are excellent and new barrels are likely forthcoming.
